MIAMI POLICE DEPARTMENT CURFEW GUIDELINES

Our security patrol has provided the following information to clarify questions that the patrol officers have been receiving from residents and members.

The City Manager has promulgated and ordered Local Emergency Measure 20-05, establishing a general CURFEW throughout the entire territorial boundary of the City of Miami. The curfew goes into effect daily beginning on March 27, 2020, from 10:00 p.m. to 5:00 a.m. and prohibits pedestrian and vehicular movement, standing, and parking during curfew hours. There are only a few limited exceptions which allows persons to be out during curfew hours as long as they are engaged in:

• Essential state, county, and City emergency services (such as police, fire-rescue, and hospital services, including the transportation of patients).
• Utility emergency repairs.
• Emergency calls by physicians or seeking emergency medical assistance or going to a pharmacy.
• Food delivery services and third-party food delivery drivers (persons not delivering food are prohibited from travel to restaurants or stores to pick-up food).
• Walking of dogs within 250 feet of the owner’s residence.
• Travel to and from work at Essential Retail and Commercial Establishments as defined in Miami-Dade County Emergency Order 07-20 (see Reference Guide on MPD SharePoint).

NOTE: EXCEPT FOR THE LIMITED PLACES LISTED ABOVE, ALL BUSINESSES MUST BE CLOSED DURING CURFEW HOURS INCLUDING GAS STATIONS, CONVENIENCE STORES, AND OTHER BUSINESSES DEEMED ESSENTIAL RETAIL AND COMMERCIAL ESTABLISHMENTS IN MIAMI-DADE COUNTY EMERGENCY ORDER 07-20.

Officers are reminded to inform and educate the public about the City’s new emergency measures including this curfew. Every effort must be made to accommodate homeless persons at shelters and no arrest are to be made if no shelter is available. Enforcement for violation of any of this Local Emergency Measures is enforceable by arrest/promise to appear pursuant to Sec. 252.50, Florida Statutes, and at this time should be considered for persons refusing to comply with the City’s curfew. MPD personal are reminded that all curfew arrests must be authorized by a Field Duty Lieutenant.
